It's probably saving them money from all the lawsuits that would be filed from little kids and idiots choking. Somebody would eat the toy on purpose then sue the hell out of them.
It is legal in several states. Namely new York west Virginia and I believe Texas. Could be wrong though, and just because it's legal doesn't make it any less odd.

I dont get it, is the US government afraid the people will peel a Kinder egg, plop it into their mouth and choke? Is that the reason? Because everyone eats it bite after delicious bite.
I've never understood this ban. Happy Meal toys are choking hazards which is why McDonald's keeps a stash of "toddler toys" for kids under 3 (of is it 4?). How is this different? If your kid is too young for a Kinder toy, don't buy one. It's just that simple.
I guess it's easier to ban something than have parents take responsibility for their children.
Few parents in this world want to take any responsibility for their kids (or themselves for that matter) which is why they can get away with suing mcdonalds for spilling a drink they know is hot on their crotch because the cup did say "hot liquid"
kinder eggs = death
alcohol=legal
pot=somewhat legal
guns=legal
cigarettes=legal
bestiality=a little bit legal
chocolate eggs with toys inside=illegal
America...

That was a legitimate issue that needed to be addressed.
