Honestly the open container thing is so fucking stupid. Just check the damn driver for alcohol breath. If he's clean, the whole car's clean. A drunk passenger is no more distracting than a twitchy and bitchy twelve year old. Probably less so actually because you can yell at them to shut the fuck up and slap them when in today's world you can't raise a hand against anyone under 18 without being called a child molester or whatever.
