The post states that he agreed to take family pictures with her, so these photographs were taken with his consent assuming that's true. HIPPA refers to PHI, protected health information, and defines what constitutes a designated record set which are all the documents that make up a medical record. This photo doesn't seem like something that could be considered related to his medical record. Now if it was a photo of her getting him ready, helping him down the steps or something like that then yes maybe.

I have to say though the other two vehicles are parked so close to the lines he'd be lucky to be able to open his car door to get in or out.
