If someone is committing a crime, which a violation of civil rights (which includes antidiscrimination) would be considered, there are loopholes. Also, there is a difference in admissibility between criminal and civil courts. But, as I also said, if it is a case of working in a large company the recording would probably only need to be given to a higher ranking boss, because the offending supervisor is an obvious liability to the company and they wouldn't want her there. If it does merit legal or civil action, it would most likely be settled out of court rather than receive negative publicity.
