The tips aren't actually theirs, they belong to the restaurant. The restaurant then gives them back the tips they earn to get above minimum wage. If your pay + tips don't add up to minimum wage the restaurant is required to pay the difference, at least that's how they work around it in NY.

That doesn't make sense. Copyright issues would be with the person who took the photo not the people in it. If it worked like that all those horrible celebrity magazines would have gone out of business a long time ago.

Since you can see through them and clearly make out what's behind them they aren't translucent. Translucent is something like frosted glass that allows light through but you can't make out what's on the other side.
