I think as long as you are not on the base(white square) and u got tapped by a person who holds a ball, you are out. In this case the person faked that he threw the ball back, and waited the guy to not step on the base and tapped him. correct me if im wrong

But why would the guy throw the ball to someone else if he had the chance to tag the guy in red?

A person can be tagged out at anytime when off the bag as long as the person taging has the ball. He does not have to throw it back to the pitcher right away. It is the runners responsibility to stay on the base. He can ask the umpire to step off and be safe to fix his clothes.
