Impaling people wasn't unusual.
If you want to learn about cruel and unusual punishment AND growing trees, you should know that chinese tied people to the floor, right above seeds of bamboo. bamboo grows quite fast, and is very resistant, so in more or less three days, bamboo would grow through the prisoner.

He would take the wooden stake and sit them on it just far enough they'd slowly and painfully slide down the poll slowly impaling them. This could take up to a week. Also, it wasn't uncommon for asian countries to use bamboo as weapons and for torture since they realised its versatility.
I'm finding myself slightly disturbed by how interesting I find these cruel ways in which humans would punish one another. Must be this damn psychology degree.
Actually, trees grow from the tips, not the base of the trunk... so it wouldn't work that way, because the branch (as long as it's attached to the tree) will always be that far off the ground. The striped pants man is totally safe.
