it would actually be put as why can you not instead of why can not you. I don't know why I just remember learning about it in english class. It's just the way we properly put it into sentence form. Frickin weird tho

Umm....no, it's just that 'can't' is a shortened version of 'can not', so it doesn't make much sense that 'can't' would make sense in some situations when 'can not' wouldn't.

It's correct the original way.
Furthermore, to make it work, the sentence would have to be changed entirely. Something along the lines of: "why is it that you can not get me ice cream?"
