Had the law stated it couldn't be more than 5 feet high, rather than 5 feet tall, he probably would have lost that lawsuit.

And if it stated no barrier is to be higher than 5 feet as well. Because if you just say fence, then you have the open loophole to where someone's gonna go crazy and attempt to build the Great Wall of China in their backyard.
