Sorry to say, but is that the same dog? I mean the length of the tail is different

Ya, it is. And if it isn't, the first dog will still look good after being adopted.

The length of the tail is the same. It's just that in the first picture you can see that the dog is scared and obsequious and therefor it has it's tail underneath it self. But in the second picture, it's a happy dog, probably wagging it's tail. And then it looks shorter, becouse it's not curled up underneath the dog.
