Marriage isn't a constitutional right. Go read the the Constitution and Bill of Rights; it's not there. What is there is State's rights (10th Amendment) staying that anything not enumerated to the federal government is the responsibility of the states. That means all things related to marriage are the responsibility of the states. This is also why DOMA was rightly struck down. The federal government has no business dictating which marriages are acceptable.
