In summary, it is the the intellectual and creative property of the TAKER of the photo, not the OWNER of the camera. Because in this case, the subject it non human it cannot be copywritten and is therefore public domain.

If he had done something to the photo during editing, this would probably be a different stroy entirely. If you want to blame someone though, blame his agent. Their the one that let the cat out of the bag in a press release that he didn't take the picture.
