It's pretty damn smart, they either have to release her for a wrongful arrest or prosecute her for a crime that only women can commit, and so acknowledge her gender.

There's nothing in the law that says that only women can commit indecent exposure with their breasts. It's reasonable to assume that the average person would be offend by him showing his very female-like breasts, therefore the charge of indecent exposure would likely be deemed reasonable.

Except fat guys on beaches display their moobs out for the world to see at beaches and don't get arrested.

Not how it works. If a girl bought a dildo and taped it to her pants she'd still get arrested for it. The only difference would likely be the charge wouldn't be indecent exposure.

agreed. I have a friend who's half South African- her mother is full South African but she's still white
