Sadly, cruel and unusual punishment is against the constitution. That's why people are debating death row. And if they were to bend this then they would be allowed to change any rights, and they'd probably go after the first one.
It wouldn't be punishment, it's an entirely optional thing to opt into.
However, it is argued that the DP is cruel by nature because of the psychological torture involved.
Oh, well if we're talking optional then yeah. They could also make human testing an option and then we won't have to hurt innocent animals who may or may not even react the same as humans would.
( that's not sarcasm, I feel it comes off that way though )
And the winner gets their current sentence halved, rounded to the nearest week.
IIRC the US can't sentence people to life; they can only sentence people for an absurd amount of time like 150 years, so this would work fine.
They should slip a cyanide pill into the food and wait for someone to drop dead. Make it small enough to not be able to find it. This will give the prisoners something to think about on death row. :)
