Here's the thing...as a civilized society, we've decided that it's not illegal or a war crime for uniformed soldiers to kill their enemies in a declared war. It *is* illegal to go out to hunt down and kill people for things they've done. You or I can't kill a serial killer even if we track him down and are pretty sure he's guilty.
