Dick move.
If it was me, I'd hope their fire alarms and insurance were good, because if I ever saw fire threaten their house, I'd let it burn.

The construction of the house violated local building code. That is illegal, punishable by fine and even by placing a lein on the property.
It is the fault of the contractor who built it. It is on them to know the building code.

The building is still blocking his view even after it was corrected, so now his view is blocked and he has to see a big middle finger. If his view was that important he should have bought the plot of land for himself.
