That quote is referencing whether a soldier believes a mission will fail ir not, not whether a command is moral or legal. If a commandung officer us breaking the law or doing something grossly amoral, a soldier is required to report him, not to blibdly follow. That is a distinction few realize, unfortunately.
It's a soldier's duty to ignore/question/disobey illegal orders in the US army. It's why the "I was just following orders" excuse doesn't work during a court-martial. A bunch of Nazis also tried to use that excuse at Nuremberg... didn't go over well at all.
