The post states that he agreed to take family pictures with her, so these photographs were taken with his consent assuming that's true. HIPPA refers to PHI, protected health information, and defines what constitutes a designated record set which are all the documents that make up a medical record. This photo doesn't seem like something that could be considered related to his medical record. Now if it was a photo of her getting him ready, helping him down the steps or something like that then yes maybe.
I read that: There needs to be written consent from the patient (slippery considering he has dementia, which shouldn’t be disclosed in the first place by the worker, that’s a need to know issue), and despite it not being a case of PHI, the stipulation does state, “Photographs or any form of PHI.”
I’m grasping at straws lol, but I basically agree with you totally, all that really matter imo is that the guy is happy during the holidays.

He looks rather young, so awful he already has dementia
Younger onset dementia is an absolute horror, and progresses so quickly. It truly is awful for everyone involved - those with the disease, and those who love and care for the person.
Good for this lady.
