Why is the person driving even filming? Isn't it illegal to use your phone or whatever whilst driving? They should be concentrating on the road.

You're correct, driver shouldn't be using their phone at all.

I don't think it's illegal everywhere. I think I'm the US it's a state by state basis. I know there was a law passed recentlyish in Oklahoma banning texting and maybe phone calls and cops can pull you over on suspicion if you have a phone out here.
