Hi there, lawyer here: B&E is illegal, and like all illegal things, it's fact specific and opens the door to all sorts of defenses. I.e. If it's freezing outside to the point you could die, you can break into an empty house, burn a chair for firewood in the fireplace and cite the defense of sudden emergency. As long as you pay the homeowners for the broken chair, no jail time; you're protected! Similarly, if an undocumented person is running from (insert terrible thing, e.g. terrorist regime), many legal scholars believe some sort of defense should be in place to protect them.
