Last summer is a bit more than 60 days at this point of course, but it is worth noting that the woman in the case DOES have to register as a sex offender, and she did receive a sentence of 10 years mandatory probation- meaning that if at any time within 10 years she violates probation she will serve the time. In theory anyway. Now- most people, myself included do feel that her gender played a role in the unusual sentence- the prosecution was asking for 20-40 years… though there is a case to be made that a first time offender deemed low risk doesn’t warrant a lengthy mandatory sentence, and based on character, history etc. the judge seems to consider her a low risk offender. And of course- one factor that generally impares a perception of low risk in sexual crimes is when the accused is a woman- so any way you slice it it is true that if a man committed a crime of identical circumstances with a 13yo girl he’d probably not get 60 days and 10 years probation.
So the point here isn’t that there isn’t gender bias in sentencing or that this woman shouldn’t have gotten a harsher sentence, though there is a larger discussion about the punishment and rehabilitation of various Troyes of offender to be had- it’s that the meme is misleading in that it omits important details that could make it seem to imply this woman didn’t have to register as a sex criminal or face any other consequences. Perhaps still not enough for her crimes, but it isn’t a case where she ONLY got 60 days. If you don’t like it, I recommend contacting Texas representatives. While at it there are a host of other laws and practices of the state you might consider also griping about.
As another little detail- her sentence was deferred a year because she’d recently given birth. Now, we can say it is humane to give a new mother grace in such a situation but many mothers from different socio economic groups or various demographics don’t get such grace either and it would be rather uncommon for a court to delay a sentence on behalf of a new father- so the ugly head of bias justice rears itself in more ways than one here.
Oh- don’t worry. The baby was NOT the kids, it had another father. Good thing too I guess given Texas law on abortion. Man. Lots of work to be done in Texas it seems. At least the rich don’t have to worry about Taxes there though. So a great state to be rich or a female rapist I guess, if that’s where one is happiest living.
