From what I understand, it was a safety issue. For all we know, the city did build the stairs.

They fall - break a hip - lawsuit would be way more than 65k

Like I said last time this was posted here there are several code violations that I can spot. If it's on city property the city would have no recourse other than to remove the stairs.
