Ok, the guy was a dick about being smart and knowing his rights. That was his biggest problem because I guarantee the moment that guy fucks up, just a little, that cop will be on his ass. And I agree that they're trying to make the place safer :)

The guy was a bit of a dick. He could have said it without being repetitive. I would have just been quiet until his superior showed up but he kept on talking and trying to force it down the guy's throat. I mean who cares if he has your ID? I would be suspicious of ANYONE walking around carrying a gun and would always be suspicious and ask for ID.
The thing about the ID id like he sd, once they have his name on record....its like a paper trail for future profiling. i guess he could have just not said anything til his superior showed up but id be jist as pissed for being stopped. i carry but only for protection. n in an open carry state u can't have it concealed without a licence. He was perfectly lawful n just being profiled cuz someone was scared of him. not fair at all.

I'm extremely pro gun, I own dozens of them, including ARs, have a concealed carry license that I use regularly, and I'm all for people knowing and understanding laws concerning guns. However, the gun owner in this video was just being a douche to be a douche. He knew exactly what was gonna happen or he wouldn't have video taped it and made such a big deal out of it. The cop was just doing his job. People called the police, it was his job to investigate it and see if whatever was happening was legal or not. The guy was obviously flaunting the fact that he had a gun on him wherever he was. Otherwise nobody would have called the police on him. I open carry and concealed carry regularly and not once have I had the police called on me. He was doing something to provoke a reaction before the cop ever showed up.....oh but wait, he didn't record that bit...hm, wonder why?
I don't see how the cop is correctly doing his job. If you know the cases that he referred to, you would know that the police can't pull you over unless they have reasonable suspicion, and that reasonable suspicion cannot include carrying a gun. The guy knew his rights and wasn't about to let that go, when the officer isn't doing what he's supposed to. There are PLENTY of cases that have gone the Supreme Court where a police officer violated someone's rights, especially their 4th amendment rights.
An investigation takes place it's illegal activity. Open carry is legal. It would be a different situation if it was possibly concealed and he didn't have a permit.
Well... this is a very gray area. It's a good thing he checked to make sure the guy wasn't a whack job. If this guy went and shot up the place then we would all be wondering why the guy didn't force him to show ID, wouldn't we? Or, at least most of us would I certainly would

Well I mean it's weird. Maybe he didn't have the right to be a douche but I know that with the heightened issues we have that there are just being cautious. Is it honestly a big deal? It was not a standard hand gun if I'm not mistaken. Suspicious people were probably freaking the fuck out. It was merely for safety, but the way it was handled was wrong.
How do you know that. We're you there. How do you know someone did not call the police sayin the dupshit carrying the gun was waving it around. Even if its a place to carry open it does not give you the right to wave the gun around like a nut job. Even if its your right. People have the right to feel like there's a problem then call the police if they want to. Then the police have probable cause to stop the guy with the gun and oh my god INVESTIGATE him. Wow you curb side lawyers are always screaming that you know your rights but then you don't. Like humpdaaaayyy was saying if someone calls in a concern then the police have the right to investigate to see if a crime is or has been committed. And like someone said before we did not see the person filming film anything he done before he got stopped. Know both sides before you start sayin the person has or has not had their rights violated before you start being the curbside lawyer and shouting out rights are being violated.

I did not say there was or was no illegal activity goin on. You are sayin that. And how do you know that there was 100% no illegal activity going on. You are only seeing what the guy videoing wants you to see. How do you know he was not waving it around like a nut just before the cop arrived. Huh. Even if he had right to open carry the gun you still don't have right to be a nut with it in public. And of course when the cop asks him what he is doing he is gonna say nothing. So unless you were there and know 100% what had happen before the guy pressed recorde then ya need to stop sayin the guy was only walking down the street with his gun doing nothing. Cause you don't know that. And if ya do then you need to be the key witness when the guy sues the PD for messing with him.
The cop stated that all that was said was there was a man with a gun. not that he was waving it around. and he was OBVIOUSLY within his rights since they did not arrest him or take his gun.
And since they did not insist on his name or ID and since they let him go. you can't just take someone's right away bc he MIGHT be a nut-case. that in itself is ludicrous
Maybe the caller refused to talk to the police. They can make calls where they don't want the police going to talk to them. So then they only got to go by what they seen when they pulled up. If a mistimeaner did not occur in their present then they cannot make an arrest. But either way they gotta invistigate to find out if there was any crime committed. So you sayin he was obviously was in his rights is still not 100% true. So then I stand with what I said before. How do you know what was done before the guy pressed record. If you know 100% sure then you can be the guys lawyer and just stand infront of the judge and keep sayin over an over that the cop violated the guys rights because the guy said he did nothing wrong and you only going by what he said. And we will see how far that gos in court. I'm gonna end by sayin that if the guy truly did nothing wrong then the cop was in the wrong and if the guy was acting like a nut and he did not get caught then lucky for him.
The police cannot investigate him. For the last freakin time, they can't investigate if there is no reasonable suspicion. And that reasonable suspicion cannot include carrying a gun. They can't just randomly investigate someone and see if they're doing something illegal. They have to have suspicion, and probable cause to search him.

I'm in high school. But I'm taking criminal law classes, so we're learning stuff like this everyday. Right now, we're going over cases having to do with the Miranda Rights.

Its really cool. We get to take field trips all the time. We've already gone to a trial and a sentencing hearing. I'm in the 1st level class which is investigation. The 2nd level is adjudication (which is mostly trials and court hearings). And the 3rd level is corrections/punishment. My teacher mostly described it as "it's all about jail time after conviction." And my teacher is an actual attorney who has prosecuted and defended many different times. Some people say is boring and they just take it because they didn't like anything else. But I actually like it and plan on taking the 2nd and 3rd level classes next year.
There's also a separate half year forensics class. Which I wanna take that one too.
My school has this career and technical unit where there's a lot of tech classes. There's stuff like health science (they have hospital beds in their classrooms with dummies in them). There's welding, construction, machine tool, automotive. Those classes have their own garages to work in on campus. There's information technology, which is programming. My brother takes those classes. There's visual communications which I think of as art on a computer. There's agriculture which mostly has to do with plants and animals. I'm also in the journalism classes which produced the school newscast and newspaper. There's all these electives along with core content classes.
I get 5 electives next year so I'm indecisive on what all I want to take.
