My point was she could have lied about being raped. I'm not "blaming the victim " I'm saying that everyone involved is a suspect, just like any OTHER crime. And IF both people were drunk, why is it him who raped her, not the other way around? (This is a legitimate question here, if anyone has an answer)

Sorry, it DOESN'T matter what she was wearing or if she was drinking? The whole point of those questions is to find out if she was leading him on and put herself in a vulnerable position intentionally. If she is being flirty and is dressed in a vulgar manner she could easily have implied consent.
I do understand that under the laws in most states (as far as I'm aware, I'm from Canada) do say that sex is never consensual if the parties involved are inhibited in their decisions (I.e. Drunk), but again it's a sexist law as in that case a sentence is still more likely to be handed to the male than the female, even if she was the "aggressor"
The case was botched, but both ways in my opinion
