Well I think It should be down, When women use the toilet the seat is always down whereas when men use it, they sometimes need it up and sometimes down (if you get what I'm saying) therefore it is used more times down then up and should stay down. It also looks better down.

My aunt's cat does that, her name is Pepper and whenever someone gets too close she run to the kitchen open the cupboard under the sink and hide.
