I see your point, but I think one thing to consider is the fact that Batman is a character in a book that was, for many years, marketed towards children. Having a popular character solve crime by just killing the criminals is counterproductive, while having a character with those self imposed restrictions forces the Batman to come up with solutions that are both entertaining and allow for the development of critical thinking. Just my 2 cents
