They can blame you. You intentionally did not move despite realising what was away to happen. If they looked up and didn't move fine so be it they clearly wanted to collide but the way you're putting kinda makes you an ass.

From the age of 12, I've been reading while walking (always a paperback in the pocket). I'm glad that peripheral vision is sensitive to motion.
