I would say more lawful evil. He was stealing a car, after all. He didn't realize there was a baby in it until afterwards.

It's not automatically a bad parenting move to leave your baby in the running car. It's only bad if it's for any more than a really quick time. It's totally possible that the parent made a quick stop at the post office on the way home or something similarly fast.
