While I can see someone TRYING to sue over it (people are stupid), the wider the IV, the more options you have when it comes medication administration, as well as how quickly you can run IV medications and fluids.
But also the greater the chance to cause damage such as a blown vein or unnecessary deep tissue bruising. Yes, they have a purpose, which is why we have them, but that purpose is sure as hell not petty comeuppance.
Using the wrong needle IS the case. They don't have to prove it was done out of malice, just done. It's negligence. If they proved it was done intentionally out of spite, then it becomes assault and a whole new can of worms is opened up.
