"New States may be admitted by the Congress into this Union; but no new States shall be formed or erected within the Jurisdiction of any other State; nor any State be formed by the Junction of two or more States, or parts of States, without the Consent of the Legislatures of the States concerned as well as of the Congress."
So if they want to do it. north and south Dakota's legislatures have to agree on it. And the US Congress approve it and the Pres sign off on it? So difficult not impossible.
I wasnt correct so that's my bad, i haven't read the constitution in a good bit.
West virginia is weird. I can't find a source where the state of virginia consented to west virginia becoming a state before 1911, where they conceded claims and gave validity to the secession.
West virginia split in the midst of the civil war. That, in my opinion, begs the question of whether the civil war was between states and the union or two separate governments. The north saw it as states against the union but the CSA saw themselves as their own entity fighting a different form of government. If we follow the line of thinking that it was insurrection amongst the states then wouldn't the consent of the state of virginia be needed in order for west virginia to split? Whereas if we follow the two separate governments thought then the consent of virginia isn't necessary as west virginia joined the union on its own accord after splitting from another nation.
Im 90% sure that WV split because of slave politics and representation of slave vs non in the US Government. Because there were slave states that didnt secceed. Maryland for example.
Makes me want to force it
