Kinder Surprise is not the same as Kinder Joy. Surprise is a chocolate egg shell surrounding a toy while the Joy has the toy separate from the snack. The Surprise is what is illegal in the US.
And it comes in an egg shaped package. The article doesn't say loot boxes are like a Kinder surprise. It doesn't say loot boxes are like a Kinder joy. It says loot boxes are like a Kinder egg.

You keep thinking the Kinder Joy is the same as the Kinder Surprise. They are two different things and in my opinion, the Joy is an inferior copy to the Surprise. I miss getting Surprises from my local bakery down the street in Germany. I was excited to see Kinder in the US the other year but my joy (pun intended) was short lived when I realized what the Joy was. I want a chocolate egg to enjoy and a little yellow container with an unknown toy inside.
technically speaking, the guest here is right IF you consider the kinder joy to not be an egg. The kinder surprise is an egg shaped chocolate while the kinder joy has an egg shaped container that splits in half into what is basically a weird shaped bowl and some pudding. Logically one would likely just call it an egg since the packaging is egg shaped but depending on the individual one might deny such an observation as the actual product itself is not egg shaped, only the packaging, and you wouldnt call "bob's banana" (made up product) a "bob box" if said banana was bought in a cube shaped package.
also @nicegelman you cant argue that "oh im only responding to specifically this post" when the source of this post (Meaning the article that the post is a screenshot of) in context of the stuff its speaking of is meaning a kinder surprise. That's literally admitting your entire comment chain is just you taking the post out of context which is just bad form
I know that. What I'm saying is the point is completely moot because Kinder Eggs are legal in the US now. The only difference is that one side has chocolate and the other the toy, rather than the toy being in the chocolate. It's still an egg with a random toy inside
