I could actually see a case- as of this writing no ruling has been made by US federal level courts on the subject- but technically getting a tattoo of a copyrighted and/or trade makes image or character is illegal. Most ethical tattoo artists won’t copy another artists work- many won’t even finish or do additional work except cover ups on a piece that isn’t theirs without permission. It’s right in the name- tattoo ARTIST. Their original work is copyright art. Many artists make sure by having you sign a form that makes their copyright and your rights explicit. A tattoo is a fixed medium display and theoretically fits all copyright laws. Fair use laws apply to non profit displays for the public good or education. Using a picture from the movie you are selling on eBay is fair use- using it as a mural on your day care is not. The purpose of use (not just wether you make money or not, how much of the work you used, the work itself, and the impact on the original holder and their market.

Technically speaking- the majority of fan art and fan fiction do NOT fall under fair use. In these cases it’s merely that the owner doesn’t want to enforce it, or is unaware of the violation. Mike Tyson and Warner found themselves being sued for violation of copyright over his facial tattoo and its use on another actor for promos of the hang over- various NFL stars etc. have been sued as well- but these cases have all been settled out of court. It’s tough to say what a court would rule- is a tattoo fair use? Who gets sued if it isn’t- the bearer of the artist?

Tough to say. But say someone in the public eye like a porn Star got a tattoo of Spider-Man on their penis- it’s very likely that Disney May sue or duke some sort of injunction to prevent the public from being exposed to their copyright material in that capacity. A private person- Disney may not have much reason to sue- and probably wouldn’t know- but they very likely could sue if they knew.
