Not sure. I mean very few people actually eat the peel, so the food isn't exactly contaminated?

But couldn't this be counted as them breaking the peel, and contacting the food inside?
I know they're not going all the way through it, but couldn't someone legally argue that?

If they don't puncture the peel it's not broken though. I mean you can literally press your nail against a peel and cause a bruise without puncturing it at all
