That wasn't nitpicking, honey, that was pointing out that they're still settling for something in the "any non-hetero/non-gender-conforming character is somehow abusive" genre. Nitpicking would be pointing out that Dr. Frankenfurter is a transVESTITE, not transgender.
I'm not advocating for him, but they both did realize that it was Frankenfurter in both of their scenes and told him to keep going. So the beginning isn't consensual but then it does become consensual.
I get that it becomes consensual but the point is that starting out nonconsensual does make him a rapist, even if the latter part would basically render it completely unprosecutable.
Yeah I guess so, but just from this evidence we can't say that he ever raped anyone. Because like you said it would become unprosecutable because they both did consent to it. So than would that make him a "sexual assaulter" or "sexual offender" (whatever the word is) instead of a rapist?
Legally, it would make him, absolutely nothing. If you can't convict of a crime, it would be libel to publically print that he is a criminal. In literal terms, it would still make him a rapist, because one cannot retroactively consent to something.
Rape by fraud is still rape. And consent cannot be granted retroactively, besides which, the consent he obtained was by coercion/under duress ("You don't want Brad to see you like this, do you?")

It's not "what would you do in this situation", it's "If this situation plays out, according to this argument, did I or did I not steal your car?" Second, just because someone makes different decisions than you would have in handling aggression, does not make the aggression somehow their fault.
And third, trust me, from personal experience, you never, NEVER have any idea until you've been in a certain type of situation what kinds of pressures are going to be involved, where you'll see them coming from, and how you're going to react. I never knew until someone accidentally nearly killed me that I can red out. That screwed up the situation royally.
For starts I was almost raped but I stood my ground and faught like hell. I was no way in hell going to let that guy do to me what he had in mind. I called the cops on his ass the second I got away and he was caught a block away tring to break into a house.
So when some whines to me I couldn't do anything I was helpless to hell you were fight for your self claw bite spit hit. If you think no matter what you do you will die fight and get the fuckers dna under your nails. That way they will find the basterd. I would rather die fighting than die makeing it easy for them.
Only person anyone has any right to say they couldn't do anything is if they are children.
