Yeah, so? These are different people, different crimes, different courts, different circumstances. Anytime you commit a crime, no matter how minor, there's a chance of running into some weird mandatory law or being "made and example of." It really doesn't matter if you think it's "NOT FAIR."
Maybe he's just not a lemming? While I totally advocate legalization of pot, and while I think its a terrible idiocy to jail a person over some pleasant herbs, its just absurd to compare crimes and judgements the way its normally done. Each case is to be seen individually. You may have good reasons to find one sentence to mild and another too harsh, but "comparing" both just doesn't make sense. Guest above outlined the reasons why pretty well.
raping that chick totally not right. What I wonder is ... Where was her sister and the friends she was with? How did she end up so drunk and alone?! This is another issue entirely that Americans don't want to face. Intoxicating the body with poison and then not having the proper mates around you to keep you safe in such a vunerable state. Alcohol people. It all boils down to its acceptance and the complete lack of realizing that it is completely inacceptable to put yourself in such positions. Again, it's totally a miscarriage of justice in this case and I feel horrible for the victim but we need to start at the root of most of our problems in such scenarios.
the OP is in no way blaming the victim. Being told that individuals need to be responsible is not at all the same as blaming the victim. The rapist is the only one to blame. No one is saying otherwise.

I'm not sure what California's laws are specifically, but the rape charges were dropped after there was no evidence found of contact between their genitals.
