I think it's actually attempting to escape isn't illegal, bug actually escaping is
Because they believe there's a human need to be free

Yeahhh.. And it's my natural need to kill someone who annoys me, or owes memone.. I needed money to naturally eat. And "I only stole to feed the family, it's not my fault I have big Italian family, and some of them needed cigarettes and stuff " - fat Tony from the Simpsons. It's all natural.
Funnily it's true, but there is a bunch of related things that are illegal:
- helping somebody to escape is punishable
- if a large enough group escapes, it may be punishable
- hurting anybody in the process or damaging property is punishable
So the attempt or actual escape is indeed not a crime...
Not only is it illegal in America to refuse the States' generous hospitality, but if you miss a court appearance because you were already in jail you'll go to jail!
You guys do realize that german prisons are quite different from american ones. The prisoners are in a more comfortable situation as well as given much better rehabilitation so that they dont come back. Most of the time they dont want to escape. Something the american prison system should try to do.
"Sir, you've been put under arrest for murdering someone"
"No"
"Alright then that concludes this trial"
