Depending on where you are. The nitrogen is usually in gas form, there's oxygen in there (it finds a way to sneak in). It's air.

They sell you what it cost to make, deliver, and advertise the chips plus money for profit. You are not buying air you are paying for a product. If you want to complain about buying air go to ebay people sell jars and bags of air from certain places in the world and from concerts.
