Yes. People need to practice a bit of caution and reasonalble personal responsibity. I agree with companies having to pay out for shit that they know is wrong and still run with it. Faulty brakes, airbags and things like that. That lady ordered hot coffee and spilled it on herself.
Gonna have to agree with @popsy here, if it was her own fault then why would Maccas pay for it just because it's on their premises? If it was an employee who spilled it on her then yeah they should pay.
The lid wasn't properly placed and the coffee was excessively hot, around 200 degrees, which can cause 3rd degree burns in less than 10 seconds. She didn't just get scolded: she had to get skin grafts and suffered muscle damage as well. There's this persistent myth that it was a frivolous lawsuit, but the store was massively in the wrong and she received around $640,000 from the suit.
@pripyatplatypus is right. She didn't sue because "it was hot." She sued because it was hotter than industry standards, and was very unsafe. Have you seen the pictures of what it did to her @popsy? It may change your mind. I used to think along the same lines of you, but I saw a documentary about it, and there is actually much more to the case than just "I spilled something and it is your fault."
If it's hot enough to cause 3rd degree burns, and your thing is that she spilled it so it was her fault, imagine if she'd drunk it rather than spilled it. Just because it fell on her rather than her drinking in doesn't negate the fact that it was way too hot to be given to a customer.
Yeah , I took a new look at the story , she did take the lid off and had it on her lap while put the cream in. It was +180 degrees. That is too hot for take out. The McDonalds lawyers were pricks to her, unreasonably so.
I see the McDonalds case extensively discussed here. What nobody seems to know is that the plaintiffs claim was that McDonalds was serving coffee much hotter than common practice.

Hi Mialinay. I read an article about the story and it had me wondering why the driver (the customers went to the drive through) was letting an 89 year old woman put the coffee on her lap to add the cream. I was just thinking that somebody wasn't looking out for her.
