Kinda? If he dies, then he'd be guilty of manslaugher at the least, but that is unlikely to be charged. Manslaughter is the unintended killing of someone without malice. He'd probably get off free as he view was indeed extremely limited due to the man throwing himself into it. If there wasn't such clear video footage, then they'd have a difficult time defending themselves as the courts usually rule in favor of the victim (Which is a big issue with the legal system). In some states, they'd likely still be punished for not being more aware or not taking the proper action (Hitting the gas would follow that pretty well).
