He'd probably still be going to jail if she was 16 or 17, but only for a few months. If this is real and she actually was 8, he could be getting 25 to life.
I kinda see what you're saying @honeybumblebee if you're being tongue-in-cheek, but @celticrose is spot-on. Any person will *never* mistake someone under the age of 12 for an adult. Huge minimum penalties exist to deter potential idiots from going after anyone 11 and younger.

An 8yo, or even those kids who are 12-13 who think they want sex, sometimes don't understand that it's damaging them psychologically until years and years later when they are actually adults. That's why it's up to the adults to have good boundaries around children like this. And why adults get put away for so long when they don't.

Thanks for the info. I didn't mean to come off as "I see saw a reason behind the mistake" kind of thing. I just wanted to mention that kids in general are exposed to adult themes more now and that they are "growing up" a lot quicker. Maybe it's due to my area but legit some little girls are looking like adults. Also I would like to point out some actual adult women are very short in hight. But I agree no one shouldn't be able to mistake an 8yr old child in real life.
