A fetus is not counted on the census. Every human, citizen or not, is. Ergo, a fetus is not considered a human by the government. Murder is human on human with intent. If a fetus is not considered a human by the government, then it is not, legally, murder.

The census is only counted every 10 years, miscarriages happen, abortions happen, the parents might not yet know the sex, can't provide a date of birth or age.... etc... etc... etc...

Yeah, it probably won't. Never underestimate laziness.... plus the years of headaches it would induce... and the fact it would literally cost a few billion to change it; even more actually, since the next census is in April 2020... so it would have to be prepared before the end of this year. That won't happen, so 2030 would be the earliest, and by then all these state laws will be ruled unconstitutional and the point is going to be moot anyway.
