seriously? In reality, the police wouldn't pursue this, as when it gets in front of the judge, they would be slammed for wasting resources and the courts time.

I would think that the police do not have a choice. As stupid as it is, if the water is technically stolen, then they'd have an obligation to follow-up.

they have a choice based on whether or not it would be prosecuted. If they chose to charge them, it'll go to court, and effectively, you'll have multiple people being charged for the theft of one glass of tap water.

I thought they prosecuted on whether or not their was enough evidence, not whether or not it is "worth it." And technically isn't that someone else's job - to determine whether or not to prosecute. Cops just press charges?

Nah, sometimes they'll just let you off with a warning for small things; just be polite and don't act like a dickhead if the cop is trying to give you a warning, otherwise they'll escalate the situation in order to achieve compliance; and they'll win.
