The "I don't wanna live in this world anymore" meme always makes me feel frustrated. There's good! There's awesome! There's still people who realize how crazy, stupid and wrong stuff like this is! We just have to come together.
Sadly enough, my first thought on reading the headline was "Oh good, at least this happened in Canada and not America, otherwise the comments will just be filled with how idiotic and sue-crazy Americans are"
I really don't want to stand up for this woman, but in the interest of presenting all the facts: the accident happened in the early morning hours (so the teens were riding their bikes on the road in the dark), she was only going about 5 mph over the speed limit, and at this point the family had already filed a lawsuit against her for almost one million dollars even though police found no wrongdoing on her part. Idk who is to blame but I figured I would add some facts the article left out. Still very tragic though.
Can you post the link to your source? If you are right I feel bad that she has to live with the fact that she accidentally killed someone, I can't imagine what that is like just as I can't imagine how the victims family must be feeling, but she still should not be trying to get money out of the family. Yes I'm sure she has some anxiety and PTSD, most people would, but that kid is dead and his family had to bury their child so I'd say they got the shit end of the situation. And then adding a lawsuit on top of that is just awful and disgusting.
As messed up as this is, and I'm sure there is even more to the story. If you actually look up the case.
1. She was driving at 1:30 in the morning. Who rides a bike, in the middle of the road, in the dark? Thats not her fault, extremely tragic yes, but not her fault for not being able to dodge 2 unlit bikes that late at night.
2. She was barely going 5 mph over the speed limit. Ya, "speeding is speeding" but this story makes it sound like she was being completely reckless going 60 in a 25. Going 70 in a 65 however, is extremely common.
3. She "may have been" talking on her cell phone? This is just a blatant lie to slander the woman's reputation. The key words are "may have been" so that when its proven false, they can just put in a little correction and say "well we never actually said she was for sure"
No, none of this makes it right for her to sue the family that is already traumatized, but then again, they were already trying to sue her for around the same amount, even though
The person with the 2000 pound killing machine is always more responsible than the child on his bicycle. Time of day doesn't fucking matter. Turn on your headlights and watch the fucking road.
For everybody saying that it wasn't her fault that they were riding their bikes so late and how was she supposed to see them and all that bull. She is a licensed driver. It's her RESPONSIBILITY to drive cautiously and saftly. ANYTHING over the speed limit is speeding okay? She was talking on her cell as well. This is 100% her fault. It doesn't matter what time it was when she hit them, she still hit them.
As several people have already noted, the accident was NOT her fault. The police investigation did not find any negligence on her part and she will not be formally charged. The boys were riding their bikes in the middle of a road at 1:30 in the morning with no lights or reflective gear. I live in the county where this happened and know all the families involved.

Nobody wins in a case like this, but neither party should have sued to begin with in my opinion
