You really should never hold the tongue of someone having a seizure, making them lie on their side already eliminates the danger of them choking with it, and putting your hand next to their mouth only adds the danger of possibly getting your finger bitten off since they can't control how much strength their jaw muscles are using
Holding it could also obstruct their airway or break their jaw, either would be pretty shitty. Laying them down and cushioning their body so they don't break themselves is the best thing to do.

Good Samaritan laws don't actually protect the person giving care sort of. It actually means that if you know how to care for someone in a life threatening situation that you are required by law to help them. This would be one of those cases and you are correct in saying that the judge would tell her to go to hell due too this law.
This is why we have juries. He didn't rape her or assault her, he tried to save her life. So it's a good thing you're judged on a number of things by peers rather than just if you technically did anything. If she did take him to court he could always counter sue for court costs and slander.
Tips if someone is having a seizure:
• Roll them on their side. They could choke on their own vomit or spit.
• Put something soft under their head. In the jerking they could hit their head and get a concussion or worse.
• Ask if anyone is with them. If they are, ask if they know if the person has a history of seizures. Also check the victim's wallet, purse, or for a medical ID bracelet. Typically if they have a seizure disorder an ambulance isn't needed. So they have IDs to say so.
• Do NOT call an ambulance unless
- The seizure has lasted for more than five minutes.
- They are having one after the other.
- They seem to be choking or having difficulty breathing.
- The seizure happened in water
- They appear to be injured
- Or they ask you to after the seizure.
• Remain calm.
•Do not put a wallet in the mouth or get your hands near the mouth. They can't control muscles so they may bite and cause serious damage to you.
• Don't hold them down. Let the seizure run
