You haven't been in many fights, have you? Hitting second or last can also be assault. Who hit first, second, or last doesn't really mean much. It's all about the threat presented, how real the threat is, and when the threat is gone.
Having been raised with an attorney for a brother, I can tell you, unless you are in the elite few who are certified black belts or otherwise professional fighters, if you are hit first you can legally defend yourself without being charged with a crime. Now, the other person can try filing a civil lawsuit, but if its documented they were the aggressor even that is unlikely to succeed.

My kid is currently learning about boundaries and permission. He'll run up and say, "Dad wants some punches?" and wait for me to say yes or no before we start roughhousing.
Exactly, why were we ever allowing kids to hit each other? Obviously we need to teach kids the proper dueling procedures, and give them all tiny swords. Much more civilized.
