That's not a loophole. Yes, plastics are made from oil, but the litter this statistic is mentioning is plastics not oil spills like you pointed out.

I came across some articles that refer to it as "marine debris", which is mostly plastics.

Boating cannot account for 20% of the pollution. I'd be surprised if it made up more than 2%. There just are not enough boats to be doing that much,
