It depends on where the photos are taken, how many photos are taken, what the person is doing, and how often you repeat the offence in the future.

Taking pictures of someone attractive used to be a compliment (with their permission) ugly spinsters in universities ruined everyone’s good time when they decided that since no men were hitting on them; they shouldn’t hit on anyone else either.
