Wouldn't that means it's not equal? There are many factors on determining who gets Custody, how would this new rule even work?

If you look at statistics the mother gets the child more often by a landslide

Unfortunately it's true, more often than not the mother is considered the more responsible guardian even if the evidence shows the opposite and I can't tell you exactly why that is. Maybe it comes down to our past in history where women were the caretakers/gathers and the men were the hunters. As to how this rule works, I have no clue man but it's going to be really tricky to outline and implement into the court system.
