Where I live, a DWI (driving while intoxicated) is used for alcohol while a DUI (driving under the influence) could be used for medication or drugs such as pot or meth, so yes it does matter what region you're in.

It might work... depends on local/state laws. Most states don’t need a license or registration for a bicycle or for electric bicycles. It’s split state by state on “mopeds,” and occasionally scooters wether you need a license, registration, etc. and some states merely say it must be below a certain engine size to not need a license. 4 wheelers like ATV’s tend to be classed as cars, motorcycles, or completely illegal on road. Given the fact it isn’t a bicycle- the only exception I could see is an ordinance (usually local) allowing the operation of “neighborhood electric vehicles” that aren’t otherwise road worthy. this vehicle likely lacks the safety features, lights, signals etc. required by law for on road use. So she’d have to be somewhere that basically let’s you drive an unregistered electric golf cart without a license or registration. Otherwise she’s still committing a crime most likely.

There was a story about 2 months ago where a girl was driving around drunk in one, they didn't charge her because they didn't consider a motor vehicle. I find that a weird argument, as you can get charged on a bicycle. I imagine it's due to speed, as that thing's top speed is like 6 mph lol.

Lol. My guess is that factored in and it was less a legal thing than a human thing. Police have some measure of discretion in these things- and you can be ticketed for operating a not motor vehicle on a public road among other possible violations if they wanted to cite you for all violations. The truth is- most people are criminals. There are few people the police couldn’t stop at some point of the day and not get for some type of violation- but most are very petty and often they either simply don’t want to bother, or police being human- generally aren’t out to ruin people’s lives or days. They tend towards enforcement when something is particularly gross or poses some threat in their eyes- but like the double parked pregnant lady at the community college will often get a pass to run in “really quick” for some errand.
