Doesn't look like a phone to me, looks more like some sort of glasses or something of that sort.

Also he may have been able to retrieve his phone, if not the rest depending on where they landed

Wouldn't even really need them although they would help his case, camera footage is considered a flawless witness in the courts, its not swayed by emotions or influenced by money. (Which is why it's almost always admitted in shoplifting cases.) I have a good bit of experience with custody cases, having not only won one myself but helping another father win his case against the same woman.
